You acknowledge that the Thomas B. You agree that the Thomas B. You agree to indemnify, defend and hold harmless the Thomas B. Fordham Institute’s election, to the repayment or crediting to you of an amount equal to the purchase price of the goods. 18. Termination

The Thomas B. Fordham Institute may, in its sole discretion, with or without notice, suspend or terminate your use of this Site, and remove and discard any Content on the Site, for any reason, including, without limitation if you violate these Terms. Regardless of any statute or law to the contrary, you hereby waive your right to bring any claim against the Thomas B. Fordham Institute more than 1 year after such claim first arose.

21. Arbitration

Any controversy or claim arising out of or relating to these Terms will be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim will be arbitrated on an individual basis, and will not be consolidated in any arbitration with any claim or controversy of any other party.
